Terms and Conditions

1. Use of GIRO facilities is deemed acceptance of the terms and conditions herein. The Bank's prevailing terms and conditions governing accounts, electronic services and other services continue to apply.
2. The Bank is entitled to debit your account for all charges, fees or other sums payable to the Bank or the Bank's agent.
3. The Bank is not obliged to effect payment if the billing organization does not request payment in the manner required by the Bank, or if your account does not have sufficient funds to meet it or to meet payment of all charges, fees or other sums payable by you to the Bank of the Bank's agents. A fee for unsuccessful debit instructions may be charged. The Bank may permit a debit at its discretion even if this results in an overdraft on your account, and impose charges accordingly.
4. On the date of effecting payment, the Bank reserves the right to determine the priority of this payment instruction against any cheque presented or any other existing arrangements made with the Bank.
5. The Bank may terminate this facility at any time by notice in writing to the applicant at the last address notified to the Bank or without notice at any time after being advised by the billing organization that no further payment is required.
6. This instruction will remain effective notwithstanding your death or bankruptcy/liquidation until notice of such death or bankruptcy/liquidation or the revocation of this instruction is received by the Bank.
7. You consent to the Bank's disclosure of information relating to your account and the GIRO facility to any relevant billing organization or other party for the purposes of or in connection with the provision of this facility.
8. You agree to absolve the Bank from and indemnify the Bank against any losses, liability or damages whatsoever in respect of undertaking your instructions, or arising from any error, delay or omission in the payments, save where caused as a direct result of the Bank's fraud or willful misconduct.
