Terms & Conditions Governing the DBS Education Digital Relief Package 

  1. DBS F&B Digital Relief Package (the “Relief Package”) is a referral program of DBS Bank Ltd. (“DBS”) to assist its Small and Medium Enterprise (“SME”) customers in food and beverages business in need of a digital solutions. DBS will refer the eligible SME customers to DBS’ partners, which are well-known service providers (“Service Providers”) offering digital solutions, which may cater DBS SME customers’ needs. The solutions in this Relief Package is available for DBS SME customers only, and is valid from 12 June 2020 to 31 December 2020, both dates inclusive.
  2. Only the individual who has the authority to act for and on behalf of (the “Representative”) the company indicated in the online application form (the “Company”) can apply for the Relief Package, for and on behalf of the Company. DBS may require additional documents or do any means necessary to verify such authority, as applicable. 
     
  3. By applying for and/or participating in the Relief Package, the Representative, in its capacity as individual and for and on behalf of the Company (the “Applicant”), expressly acknowledge that the Applicant have read and understand these terms & conditions governing the DBS F&B Digital Relief Package (the “Terms and Conditions”)  and have agreed to be subject to and bound by the Terms and Conditions. The Terms and Conditions are strictly confidential and may not be shared by the Applicant with any third party except based on prior written approval from DBS. 
     
  4. To qualify for this Relief Package, the Applicant must:
    1. acknowledge and declare that the Company is; (i) incorporated and registered in Singapore; (ii) classified as SME by Enterprise Singapore; and (iii) have no less than 30% (thirty per cent) of its shareholding held by Singapore citizens or Permanent Residents;
    2. access the Relief Package public webpage and submit to DBS, a completed online application form selecting at least one solution, through any one of the following channels:
      1. Relationship Managers;
      2. Relief Package public web page;
    3. Fully comply with this Terms and Conditions, and its variation or amendments that may be made by DBS from time to time.
       
  5. Eligible Applicants will be contacted by a DBS representative to confirm their interest. The DBS representative will ascertain the viability of their selected solution/s and direct them to the appropriate Service Provider(s).
     
  6. By submitting the online application form of  the Relief Package, the Applicant:
    1. consents to DBS referring its application details to the respective Service Providers for subsequent follow up;
    2. acknowledges and agrees that DBS’ decision on the approval to its applications for the Relief Package are final and made at DBS’ full discretion;
    3. acknowledges and agrees that the digital solutions offered by the Service Providers in the Relief Package shall be subject to the terms and conditions that the Applicant may need to agree with the relevant Service Provider(s) separately from this Terms and Conditions; and
    4. confirms that it is lawfully providing the information submitted in the online application form or any information as may be requested by DBS from time to time in relation to the Relief Package (including any Personal Data), for DBS to collect, use, disclose, process and store for the purposes of: (i) promoting, conducting and administering the Relief Package, including any communications relating to the Relief Package; (ii) providing products or services to that Applicant, whether in connection with this Relief Package; (iii) meeting the operational, administrative and risk management requirements of DBS Group Holdings Ltd. and its related corporations (“DBS Group”); and (iv) complying with any requirement, as DBS Group reasonably deems necessary, under any law or of any court, government authority or regulator;
    5. undertakes, represents and warrants to DBS that in relation to any Personal Data that the Applicant is disclosing to DBS, the Applicant has notified such individual of the purposes for which DBS may use his/her Personal Data and has obtained such individual’s consent for the collection, processing, use and disclosure of his/her Personal Data by DBS in accordance with the provisions of the terms and conditions of the Relief Package.
      In the context of Clause 4(d) and (e) above, Personal Data means personal data as defined in the Personal Data Protection Act 2012 of the Republic of Singapore and its amendments from time to time.
       
  7. DBS reserves the right to withdraw, substitute or replace the Relief Package with other solution(s) without giving prior notice or any reason and without incurring any liability to any party.
     
  8. To the extent provided by law, DBS may vary the Terms and Conditions at any time by publishing the amended terms on DBS’ website: https://www.dbs.com.sg/sme/covid-19-relief-measures.page. The amended Terms and Conditions shall take effect and bind the Applicant upon publication.
     
  9. DBS’s decision on all matters relating to this Relief Package shall be final. No correspondence or claims will be entertained.
     
  10. Under no circumstances will DBS be held responsible or liable in any way for any claims, damages, losses, expenses, costs or liabilities whatsoever (including, without limitation, any direct or indirect damages for loss of profits, business interruption or loss of information) resulting or arising directly or indirectly from the Applicant’s association to, use of or inability to use the Relief Package solutions offered by the Service Providers, or from the Applicant’s reliance on the information and materials on the Relief Package solutions that the Service Providers provided on the Relief Package public webpage or arising from communications or any kind of relationship established between the Applicants and Service Providers.
     
  11. This Relief Package is not valid with any other on-going offers, promotions, vouchers, rebates or privileges, unless otherwise stated.
     
  12. These Terms and Conditions are governed by, and shall be construed in accordance with, the laws of Singapore.
